As a solvency and bankruptcy expert, Peter has represented trustees, creditors, debtors, loan servicers and defendants on various issues, including the following:

  • Avoidance actions (principally, preferential distributions and fraudulent conveyances)
    • Solvency analyses
    • Analyses regarding ability to pay debts when they become due and inadequate capital tests
    • Normal course and new value defenses
    • Computer forensics, including extraction of paid vendor history data from debtors’ and creditors’ accounting systems to identify preference targets
    • Accounting reconstructions
  • Business valuations and valuation of financial assets (e.g., restructured debt)
  • Lender and bankruptcy fraud
  • Consultant and negotiator in connection with approximately $500 million of securitized debt, including reorganization plans, feasibility opinions, valuations of restructured debt, and complex financial models
  • Expert witness testimony regarding motions to appoint a trustee and bankruptcy fraud
  • Asset tracing
  • Taxation of Receivers and Trustees

In addition to being a Certified Public Accountant, Peter has extensive bankruptcy-specific education, experience and training.

Peter is a Certified Insolvency and Reorganization Advisor (CIRA). To receive this certification, he successfully completed in-depth financial insolvency and restructuring program which covers all aspects of bankruptcy and reorganization, including managing financial turnaround and bankruptcy cases, avoidance actions, reorganization plan development, insolvency, financial reporting, and bankruptcy taxation issues. In addition to passing comprehensive examinations and related course work, all CIRA recipients must have a minimum of 4,000 hours of specialized insolvency and reorganization experience.

Peter is also a recipient of the Certification in Distressed Business Valuation (CDBV). This certification program includes rigorous training and examinations in advanced business valuations and the valuation of distressed assets, including distressed and/or bankrupt businesses. In addition to passing comprehensive examinations and course work, all CDBV recipients must have substantial experience in valuing distressed businesses.

Peter has also taught in the CDBV certification program for the Association of Insolvency and Reorganization Advisors (AIRA). Peter has also been a frequent speaker for the American Bankruptcy Institute (ABI).
